Notwithstanding anything to the contrary to the subject or reference, in this Act -
(1)‘competent authority’ means any body or authority established or constituted under any law or any instrument having power under any law;
(2)‘canal’ means any inlet or outlet of water;
(3)‘clearance certificate’ means any clearance issued by the Executive Committee under section 16;
(4)“Watercourses” means any water flowing out of a reservoir;
(5)‘reservoir’ means a naturally occurring or artificially excavated river, canal, bill, haor, baud, longitudinal, pond, lake, fountain or any similar container;
(6)“wetland” means any land where the surface of the water is equal to or close to the ground, or which, from time to time, is submerged at low depths, and where plants normally grow and grow in wetlands;
(7)“National Water Policy” means the National Water Policy framed by the Government from time to time;
(8)‘National Water Resource Plan’ means the National Water Resources Plan approved by the Council under section 15;
(9)“Executive Committee” means the Committee constituted under section 9;
(10)“Control” includes prohibition and conditioning;
(11)“Inspector” means any officer or employee authorised as an Inspector under section 14;
(12)“Council” means the National Water Resources Council constituted under section 4;
(13)“water” means any water referred to in sub-section (1) of section 3;
(14)‘water resource’ means groundwater, groundwater and rainwater as well as water from the atmosphere; and includes water from estuaries, water holding levels, flooded lands, wetlands, reservoirs, forts, coasts and any similar reservoirs or places;
(15)‘water resource development project’ means any programme or initiative undertaken for the development of water resources, such as construction of any type of hydraulic infrastructure built for irrigation, flood control management and drainage, conservation of river banks, dredging or any similar activity, programme or initiative;
(16)‘Water Resources Planning Agency’ means

Water Resources Planning Company established under Act 12 of 1992;
(17)“Water Critical Area” means any area declared under section 17;
(18)‘Aquifer’ means a layer of underground rock or soil that can hold and transport water and from which water can be extracted;
(19)“compliance order” means any order issued under section 12;
(20)‘Fourshore’ means the area between the low water mark and the high water mark of the river at any time of the year during the normal spring tide; and

(a) the area extending from the highest water level to 50 (fifty) m of the river bank and from the highest water level to 10 (ten) m of the other areas in the river port and sea port areas declared in accordance with Act XV of 1908;
(21)“Criminal Procedure” means

(Act V of 1898);
(22)‘Bamboo‘ means a lake in the form of a drain whose tides have gradually dwindled in the course of time;
(23)‘dam’ means any dam, wall, dyke, embankment or similar dam constructed of clay or similar material;
(24)‘Bill‘ means the natural low-lying place or circular area which is flooded by rain or river water and which remains submerged during the whole year or is partially or fully dry during part of the year;
(25)“Person” means any person and also includes any institution, company, association, partnership business, firm or statutory or any other organization thereof;
(26)‘groundwater’ means any surface water that flows through a reservoir or can be extracted from the surface by natural or artificial means;
(27)“groundwater” means any water from a reservoir on the surface of the land;
(28)“Land” means

(29)“Director General” means the Director-General of the Water Resources Planning Agency;
(30)‘estuary‘ means a body of water which flows permanently or in phases towards the sea where the ocean waters, the breadth of which is measurable, are mixed with the water flowing from the ground;
(31)“Government” means the Ministry of Water Resources for the purposes of this Act;
(32)‘Conservation‘ shall also include increasing the utility of water resources, reducing wastage and erosion, conservation and protection;
(33)‘protection‘ means restrictions or conditions for the conservation of water resources;
(34)‘Protection Order’ means any order issued under section 27; and
(35)‘Haor’ means a naturally occurring hard-shaped large lowland between two rivers.
